En momentos en que el Ejecutivo de EEUU y el Congreso norteamericano debaten sin ponerse de acuerdo qué hacer para atajar la crisis fiscal de Puerto Rico, es urgente entender las implicaciones negativas que tendría un evento desordenado de impago en el servicio de la deuda de la isla. Un análisis realizado por el Centro para una Nueva Economía (CNE) revela que sin acceso al Capítulo 9 del Código de Quiebras Federal, un impago desordenado perjudicaría importantes sectores de los acreedores de la isla, quienes enfrentarían años de impago e incertidumbre y largos litigios en múltiples foros judiciales. La razón es que la estructura de la deuda pública de Puerto Rico es increíblemente compleja, y un impago fuera del Capítulo 9 desencadenaría una madeja de reclamos y contra reclamos para los que no existen precedentes y sobre los que prevalecen un sinnúmero de interrogantes legales. As the clock ticks for Puerto Rico, what would a debt default look like without the recourse of Chapter 9 of the U.S. Bankruptcy Code? With all probability, players will face years of nonpayment, an utterly complex maze of claims and counterclaims, protracted litigation, and a myriad of open, unresolved legal questions.

In the following paper, CNE analyzes Puerto Rico’s “insanely convoluted” debt structure, and finds that very few players will benefit from the chaos of a disorderly default. We will detail some of the consequences of a default on Puerto Rico’s debt and consider some of the principal arguments in favor of allowing Puerto Rico to avail itself of the debt restructuring process under Chapter 9 of the U.S. Bankruptcy Code.
